You are currently viewing the site "DecoChic.fr, la boutique chic et romantique.." This document is intended to inform you about the ACL MEDIAS society and Conditions of Sale of its site DecoChic.fr.

These Terms and Conditions that apply to all orders placed on the Website "http://www.DecoChic.fr" are concluded on the one hand between:

  • The company "ACL MEDIAS", joint stock company with a capital of € 25 000 euros, whose registered office is located 10, rue Er Bléhua - 56340 Plouharnel - France, registered with the Trade and Lorient Companies under number 804 287 837, VAT identification number FR 66804287837 which operates the site "http://www.DecoChic.fr" hereinafter referred to as "the Site", "DecoChic.fr", "we", " Seller "or" Sender ".

And, secondly,

  • By any natural or legal person wishing to make a purchase via the website "http://www.DecoChic.fr", hereinafter called "the Purchaser", "Customer" or "You".

The parties agree that their relations will be exclusively governed by this contract, excluding any conditions previously available on the Website. However, if a condition is found to be lacking, it would be governed by the procedures in force in the remote sales sector whose companies are headquartered in France.

The Customer acknowledges that, prior to placing the order, took note of all the information referred to above, of these Terms and Conditions and comply unconditionally.

 

Article 1 - Purpose

Previously, the Buyer must be at least eighteen (18) years, be legally able to enter and use this Site in accordance with the Terms of Sale.

1-1 Object

These Terms and Conditions are intended to define the contractual conditions (Rights and Obligations) between the ACL MEDIAS Company and the Buyer, whether professional or consumer, in connection with the sale of products by the company ACL MEDIAS, done through commerce website: http://www.DecoChic.fr.

1-2 Contract Language

The products and services offered by the company ACL MEDIAS are presented in French and English language site via an automatic translation system.

This contract is in two languages, French and English via an automatic translation system, both having precisely the same meaning.

In case of disputes arising from or relating to this contract, the French language version shall prevail and has exclusive interpretation, including but not limited to, in a court.

Any citizen of the European Community and the countries complying with Directive 95/46 / EC can not claim ignorance as its linguistic contract cancellation clause.

1-3 Application Period and modifications of the General Conditions of Sale

These Conditions of Sale are valid from 1 June 2015. This edition cancels and replaces any earlier version.

The ACL MEDIAS company reserves the right to adapt or modify at any time without notice these Terms and Conditions. If modified, it will be applied to each order the General Conditions of Sale in force at the date of order.

 

Article 2 - Products and Availability

The company ACL MEDIAS makes its best efforts to ensure that the graphical representation of products to be as faithful as possible to the Products. The information on the cards products, the essential characteristics of these are those communicated by the suppliers.

In general, the descriptions (photographs, texts, graphics, information and characteristics) illustrating the products are presented for reference.

2-1 Products

2-2 Availability

The product offers and prices are valid until they are visible on the site, within the limit of available stock, subject to restocking. In case of unavailability of products from suppliers after placing the order, the Customer will be informed by mail or telephone as soon as possible. The company will offer him ACL MEDIAS providing a product similar to the same price. In default of acceptance, and if the flow of the regulation is already responding, he will proceed to refund within a maximum of thirty (30) days.

Due to the specific nature of the Internet, the company ACL MEDIAS does not guarantee the availability on its website of all products and services in real time. For products not stocked in its warehouse, the offers on the Site are valid subject to availability from the supplier.

In this framework, information on product availability are provided at the time of order confirmation. This information directly from suppliers, errors or modifications are beyond the control of the company ACL MEDIAS and can not incur liability.

If the products are not available at the time of the order, you can ask the customer service date of availability of the selected product.

Article 3 - Sales area

Online products and sold on the Site are delivered to the following destinations:

  • France and overseas territories: metropolis, Corsica, Guadeloupe, Guyana, Martinique, Monaco, New Caledonia, French Polynesia, St. Barthelemy, St. Maarten;

  • Europe: Andorra, Austria, Belgium, Bulgaria, Cyprus, Denmark, Estonia, Finland, Greece, Guernsey, Hungary, Canary Islands, Ireland, Italy, Jersey, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Montenegro, Norway , Netherlands, Poland, Portugal, Czech Republic, Romania, United Kingdom, Serbia, Slovakia, Slovenia, Sweden, Switzerland;

  • World: Argentina, Australia, Bahrain, Brazil, Canada, China, South Korea, Israel, Japan, Lebanon, New Zealand, Reunion, Singapore, Taiwan, Turkey, USA, Russia, Hong Kong

For countries not mentioned above, it is up to them to verify that the goods they wish to order can be delivered in the country where he resides and under which conditions. It may to that effect contact Customer Service by email: service-client@DecoChic.fr 

 

Article 4 - Order

Any order signed by the Customer "double click" constitutes an irrevocable acceptance which can be challenged only in the cases provided for in this contract.

Indeed, the "double click" associated with the authentication and non-repudiation and protection of the integrity of messages is an electronic signature within the meaning of Article 1316-4 of the French Civil Code.

Any agreement of a quote by email addressed to the Purchaser and returned to the company ACL MEDIAS with an explicit agreement also constitutes an irrevocable acceptance.

 

Article 5 - Ordering Process

The customer who wishes to purchase a product online must follow the procedure in the following steps:

  • Customer fills his basket of products,
  • Customer creates his account or connects to their account if already DecoChic.fr customer site,
  • Customer information information about its coordinate delivery
  • the customer is informed of delivery modes offered, chooses his mode of delivery and becomes aware of the amount of delivery costs,
  • Customer chooses the payment method,
  • Customer validates his order and Conditions,
  • if rule by credit card, the customer is redirected to a page of our partner CIC and performs his payment request,
  • Finally, the Customer receives an e-mail confirming the order.

WARNING, the amount of taxes and port fees shall be valid after intelligence displayed delivery address.

Before the final confirmation, Buyer checks the details of the order, the price of shipping and the total price. He has the opportunity to correct any errors, before confirming the order.

The Customer agrees to provide true, accurate, current and complete information about his identity, in accordance with Article 6-II of Law No. 2004-575 of 21 June 2004 on trust in the digital economy. Article 6 - Order Confirmation

All orders placed to the company ACL MEDIAS will be subject to confirmation by the latter for the order to be definitively accepted.

Indeed, the company ACL MEDIAS reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order, or as otherwise specified in this contract.

The confirmation of the order will be sent by mail to the Buyer as soon as possible, subject to the provision by the Purchaser of a valid email address subject to any restrictions of use (mail address professional for example). In this case, the company ACL MEDIAS can not be held responsible for non receipt of the order confirmation containing all the contractual information and carrying proof of the transaction.

The ACL MEDIAS company can not be held responsible for the fact that this email is cleared by a device of the "Anti-Spam".

Each order confirmation contains the deadline for delivery of the order in question.

However, without contradicting the above, provided that the Customers can pay their order by check, the order confirmation will specify a delivery time, which will not begin to run until the final check is cashed by ACL MEDIAS company.

 

Article 7 - Price

The prices are valid until they are visible on the site, within the limit of available stocks. The ACL MEDIAS reserves the right to change prices at any time and undertakes to apply the rates in force on the date of validation of the order, subject to the availability of the product ordered on that date.

Prices are quoted in euros all taxes included. They take into account the applicable VAT in France on the day of the order (French VAT and other applicable taxes, including eco-participation for items which are subject thereto). They do not include participation in shipping costs billed in euros all taxes included extra and may be specified in the order confirmation.

For delivery outside the EU, according to knowledgeable delivery address on the customer record, the French VAT will be deducted at the stage of the order confirmation. Article 8 - Payment method

8-1 Methods of payment

By bank transfer in euros from the data provided on the Site when choosing the method of payment by the Client within 72 hours. After this period, without receiving your bank transfer, the order will be canceled. The order will be processed upon receipt of your bank transfer and after validation of the collection of the amount in full. All fees are the sole responsibility of the buyer.

By check in Euros, clearable in a French bank, made out to the company ACL MEDIAS, along with a piece of valid identity on behalf of the issuer of the check and sent to the following address: Service Customer DecoChic.fr 10, rue Er Bléhua - 56340 Plouharnel - France.

Your order is reserved for seven (7) days. Beyond this period, without receiving your check will be canceled. The order will be processed upon receipt of your check and after validation of the collection of the amount in question by our bank;

8-2 Payment in 3 times free with credit card

The ACL MEDIAS company provides payment in 3 interest free (3 X toll free) by credit card from 300 euros to a maximum of € 1.000 (one thousand euros) through its banking partner CIC.

Example, for a purchase of 600 € VAT, including postage:

  •       When ordering: 200 €
  •       M + 1: 200 €
  •       M + 2: 200 €

Any use of this payment is subject to the prior approval of our partner acts as lender before confirming the order.

A committed credit you and must be repaid. Check your repayment capacity before you commit.

This payment method can result in additional processing time before confirming that order.

8-3 Payment Security

The Customer warrants to the company ACL MEDIAS that has the required permission to use the payment method chosen by him, while validating the order.

Article 9 - Retention of title

Products delivered to the Customer remain the property of the company ACL MEDIAS as the Customer has not paid the full price in principal and accessories, due under its control in accordance with Articles 2367 and 2372 of the French Civil Code . Article 10 - Execution of the order

The ACL MEDIAS company is committed to process the order as soon as possible to deliver the goods ordered at the date specified in the order.

10-1 No command execution

The ACL MEDIAS reserves the right to refuse the order for a "legitimate reason" (as defined by case law), including (but not limited to) in case of unavailability of the product, abusive request of the Customer of presumption of impossibility for the Customer to contract or a clear intention for the Customer to harm society ACL MEDIAS.

The ACL MEDIAS Company also reserves the right not to execute the order in the case of an obvious typographical error leading to display a "low price", and even after order confirmation sent to the Client. 10-2 Out of Stock

The majority of products offered on the site are available in our warehouses.

If out of stock or replenishment, delivery times range from 7 to 60 days on average. Delivery times are counted in working days.

Any order of one or more products not available will cause additional time.

If an order includes products in stock and products not available, the said order will be processed once complete. Provided that the products available will be reserved for this command.

 

Article 11 - Billing

An invoice will be automatically sent to the Customer when ordering. It will be available in the "My Account".

 

Article 12 - Delivery

When the Customer places an order, the delivery method is specified it, unless special provisions in the order confirmation email.

The Client thus has the choice to be delivered his goods (excluding furniture, which are only available in delivery to the home address of the Customer or any other address specified by him). For any mixed order product (s) decoration and furniture (s), delivery will be made only to the personal address of the Client or any address specified by him.

However do not accept the following delivery addresses: PO Box, cedex, military base ...

Remember, the Products purchased on the Site http://www.DecoChic.fr can be delivered only in some countries, it is therefore up to them to verify the availability of (s) product (s) in question directly to the service Client email: service-client@DecoChic.fr.

Products are shipped to (to) address (s) indicated deliveries (s) during the ordering process.

Shipping costs are calculated based on the type of service selected and type of products purchased.

Whatever the destination of the goods, even Excluding EEC purchased on the Site, participation in shipping means all taxes included (VAT) at the rate applied in France at the time of placing the order.

12-1 Free Delivery

Shipping fees are offered for deliveries in Point bridge with Mondial Relay in the following conditions:

  • For any order greater than or equal to 90 euros TTC for delivery in France, Belgium and Luxembourg.
  • For any order greater than or equal to 100 euros for a delivery in Spain.

Shipping fees are available for home deliveries abroad with Mondial Relay in the following conditions:

  • For any order greater than or equal to 250 euros TTC for delivery in Austria, Belgium, Spain, Luxembourg, Portugal and the United Kingdom.

The amount of the order is the amount withheld VAT, all promotion, discount, discount, discount deducted.

12-2 Delivery methods

  • Express home delivery with tracking and signature - Parcels delivered by hand (delivery against signature):
    On delivery, the customer or recipient of the Order is delivered by the clerk of the chosen transport company and sign electronically an acknowledgment
    This electronic receipt is proof of delivery by MEDIA ACL, and receipt by the customer or recipient of the Order of products ordered.
  • No dispute on the delivery itself is only possible if the package appears to have been delivered, the computer system (flashing) the carrier authentic.

In the absence of the recipient of the order at delivery, the carrier will leave a calling card and the Customer or the recipient has a period of fifteen (10) days to retrieve the parcel in the manner indicated on the calling card. After this period, the order will be returned to the company MEDIA ACL which will contact the customer to define the conditions for a possible return. Processing this new delivery costs will be charged to the Client.

Any failure or delay in delivery than seven (7) business days should be reported to our Customer Service as soon as possible.

However, if the sale involves an amount greater than 500 €, the invoice will indicate the deadline for delivery of the products. In case of exceeding this period exceeding seven (7) days and not due to force majeure, the Purchaser may terminate the sale by registered letter with return receipt addressed to: ACL MEDIAS - Customer Service DecoChic.fr - 10 Street Er Bléhua - 56340 Plouharnel - France.

If you receive the product after the cancellation of your order, you return us the complete and in its original condition for us to receive, to make repayment.

Any non claim or parcel refused immediately result in the return of goods to our warehouses in France. 12-3 Delivery

  • Chronopost (Chrono Relais): Next Day Delivery Chronopost relay point

Home delivery

  • Mondial Relay (Home Europe): Food Delivery in 4 to 6 days
  • La Poste (Colissimo Access France letterbox): home delivery in 48h
  • La Poste (France Colissimo against signature): home delivery in 48h

Express delivery France

  • Chronopost (Chrono13): Express Delivery Services, the next day (13h). If the delivery rate, deposition Post Office.

France and International Delivery

  • Chronopost (Chrono Classic): home delivery in 2-4 days (after the deadline of Customs)
  •  DHL Express (DHL Express Worldwide): Express Home delivery in 24 to 72 hours (excluding time customs)
  •  UPS (UPS Express Saver): home delivery within 72 hours (before 19h, untimely customs)

12-4 International delivery outside EEC

For delivery outside the EU, according to the shipping address provided on the customer record, the French VAT will be deducted and the goods will be shipped in value before tax.

It will then be up to the customer to adjust and duties of his country from the carrier, who, by delegation, shall act as customs agent.

The customer can obtain information on the duties and taxes to the customs service of his country before finalizing the order. The ACL MEDIAS disclaims all liability for information rights and non-EEC countries whose taxes it does not fall.

Any non claim, denial of the package or refusal to pay duties immediately result in the return of products in our warehouse in France. The customer will be refunded the amount of the order, less shipping costs if offered, the cost of return, a fixed penalty of 10 euros for administrative expenses and all related costs within maximum of 30 days after receipt of the goods in our warehouses.

12-5 Returns under the IASP pattern

These are the packages returned by the provider responsible for delivery under the heading: does not reside at this address.

After receipt and acceptance of your package by us, depending on the nature of the product, available stocks and as you wish, we will offer you reship the product initially ordered or product exchange with equivalent features at your expense. 12-6 Packaging

The products are packed with the greatest care in an oversized packaging to ensure complete integrity, so that there can be no dispute concerning their return. 12-7 Compliance of delivered goods

You must check the conformity of the goods delivered at the time of delivery and before signing the carrier's delivery.

12-8 Visible defects on delivery

Without prejudice to the application of the above hereof and the implementation of legal safeguards, LCD MEDIA informs the customer that any apparent defect in the product (anomaly, damaged, damaged package ...) should be subject to object when the issuance, otherwise apparent defects will no longer be subject to later claims.

We strongly recommend the customer to open the package in the presence of the carrier to ensure the absence of apparent defects.

Generally, in case of apparent defects, the customer or recipient of the Order must report the absence or degradation of the product to the Customer Service (as provided herein) and follow the return procedure described below. It is recommended that the Customer submit his claim by any means allowing him to keep proof of notification on schedule below.

Failure to follow proper procedures outlined below for each case of delivery, excluding any recourse against the carrier and ACL MEDIAS company in respect of apparent defects.

  • Deliveries to the point Relay
    In case of apparent defect of the product found in the presence of the attendant Point Relais
    Refuse delivery and immediately issue all reservations regarding the apparent lack of clear and detailed. These reservations must be indicated by the customer or recipient of the Order on the right ticked off Relay Point attendant.
    Report the refusal from the Customer Service ACL MEDIAS company within 3 working days from the issuance, pursuant to the provisions hereof, and communicate within the same period a copy of ticked off Customer Service ACL MEDIAS.
    In case of apparent defect found outside the presence of the attendant Point Relais
    Report damage or deficiencies found and formulate all claims and reserves with the Customer Service ACL MEDIAS accordance with the provisions hereof.
    Incident reporting and the making of reservations must be made within 3 business days.
     
  • Delivery in single mailbox
    If obviously damaged parcel, do not open the package. Warning: opening the package excludes any appeal against the Post Office and the company ACL MEDIAS.
    In case of apparent defect of the package or product ordered, bringing the package to the post office within three (3) working days of delivery.
    Establish a "damage report" with La Poste.
    Report an anomaly with the Customer Service ACL MEDIAS : incident reporting and the making of reservations must be made within three (3) working days. The copy of the damage report will be sent to Customer Service of the company ACL MEDIAS in the same timeframe.
     
  • Home delivery with tracking and signature
    In case of apparent defect of the product found in the presence of the deliveryman
    Refuse delivery by issuing an immediate finding of fault with the deliveryman.
    Report the refusal from the Customer Service ACL MEDIAS within 3 working days from the issuance and communicate within the same period the copy of the anomaly to the Customer Service ACL MEDIAS.
    In case of apparent defect found outside the presence of the delivery
    Report damage or deficiencies found and formulate all claims and reserves with the Customer Service ACL MEDIAS accordance with the provisions hereof.
    Incident reporting and the making of reservations must be made within 3 working days of delivery.
  • Express home delivery with tracking and signature (Chronopost, DHL or UPS)
    In case of apparent defect of the product found in the presence of the carrier's fighters
